Guwahati: In a move aimed at expediting trial proceedings, the Assam Cabinet on Thursday approved a proposal to request the Gauhati High Court to constitute a dedicated fast-track court for the day-to-day hearing of the case related to the demise of popular singer Zubeen Garg.
The decision was taken at a Cabinet meeting chaired by Chief Minister Himanta Biswa Sarma at Lok Sewa Bhawan, amid growing public attention and the familyโs demand for a speedy trial.
Addressing the media, Sarma said the state government will formally approach the Chief Justice of the Gauhati High Court seeking the constitution of an exclusive sessions court under Section 346(1) of the Bharatiya Nyaya Sanhita to conduct daily hearings.
โThe Cabinet approved the formation of a dedicated court for day-to-day trial of the case. We will place a request before the Chief Justice of the Gauhati High Court. Thereafter, the Chief Justice will take a decision regarding the constitution of the court and the proceedings,โ he said.
The Chief Minister stated that the government remains committed to ensuring a transparent and time-bound judicial process, considering the sensitivity of the matter.
โThis case carries emotional and social significance. The family members of Zubeen Garg seek a fast-track trial. Respecting their demand, the Cabinet decided to move forward with this proposal,โ he says.
Sarma also noted that the government had earlier considered allowing the trial to continue before the existing court for the sake of continuity, particularly as none of the accused has secured bail so far. However, in view of the familyโs request for an expedited mechanism, the Cabinet decided to seek a special court.
โWe felt that continuing before the present court could ensure continuity. But since the family asks for a fast-track mechanism, we accept their request in the larger interest of justice,โ he said.
According to the proposal, the Gauhati High Court will appoint a judge and frame necessary guidelines for the functioning of the dedicated court. The state government will provide logistical and infrastructural support required for the smooth conduct of proceedings.
